Section 7777 Constitution of Pakistan (1973), Article 203 DD appeal of unnatural crime was returned because the intolerable FIR was registered under Section 377, PPC and the accused was tried and convicted under Section 377. The PPC was neither charged nor convicted. Further, the Federal Shariat Court of Sessions Court, Gwadar, Balochistan was given an unwarranted verdict, and therefore, the present jail on criminal appeal was welcomed. And was unable to make a decision which should have been filed before the High Court of Balochistan for lack of appeal. Before the Federal Shariat Court, the accused were directed to send the accused to the High Court, the Registrar, the High Court of Balochistan, for the proper hearing in accordance with the law, through the relevant superintendent jail.
