SYED NAJMUL HASSAN WASTI versus PROVINCE OF SINDH THROUGH SECRETARY EXCISE AND TAXATION

Section 10 of the Sindh Service Tribunals Act (XV of 1973), Section 4 of the Constitution of Pakistan (1973), Arts 199 and 212 constitutional applicants after the transfer of the applicant from one year to another in the four months preceding his retirement. Retirement will be scheduled within one year. The posting was part of the terms and conditions and terms of service. The employer may, in his discretion, use the applicant's services to his or her own ability; the applicant had no legal right to claim or ask for transfer and posting to a particular post, whether it was Malala or not. The constitution was challenged before the High Court because of the bar contained in Article 1212 of the High Court.
