The conditions for seeking the provisions of Section 21 of the Law Reform Ordinance (XII of 1972), Section 21 Arbitration Act, 1940, provided that the matter could be referred to arbitration, it could be excluded from the rest. The suit; this case will continue till now and is related to the parties who did not attend the said petition and the reference is not included in the case as such application has not been made. And that in pursuance of such a reference the award shall be binding only on the parties involved in the application of section 24 of the Arbitration Act, 1940, which apparently apply to the facts and circumstances of the present case and are satisfied. From the statement of facts, the facts which were not disputed by the appellant's counsel, there was no merit in the counsel's offer for the appellant, the appeal was dismissed.
