SHEIKH MUHAMMAD NAFEES versus ADDITIONAL SESSIONS JUDGE, HAFIZABAD
Sections 3, 4, 5 and 8 of the West Pakistan Land Revenue Rules, 1968, R67B Constitution of Pakistan (1973), the scope of Article 199 Constitution Petition and the Unlawful Settlement Act, 2005 apply to the applicant inheriting from his father. When the Revenue authorities examined the matter on the petitioner's application, it was found that the defendants were in unlawful possession of the disputed land and ordered the respondent under sub-rule 7 of Rule 67B of the West Pakistan Land Revenue Rules 1968 Grant the applicant warrants to the landowner. Dakhl was legally issued in favor of the applicant. The respondents filed a case in respect of the said land which was dismissed while the appeal was received with the same fate. Revenue authorities seized the applicant but Respondents demolished the structure, several erected the wall and seized the controversial land illegally and forcibly the applicant filed a complaint before the Additional District Judge, who examined this participant in the CCP To bring the case under Section 200 of the C and all the accused persons / defendants to trial. Was summoned but the complaint was dismissed at the stage of indictment. In 2005, despite the status of the civil suit between the parties, the respondents / accused claimed that during the civil suit status, the same matter between the same party. I cannot initiate criminal proceedings and the petitioner has filed a complaint to pressurize them so that legal status is maintained among the citizens. There was no restriction on initiating criminal proceedings and both civil and criminal proceedings
