Section 12 Civil Procedure Code (v. 1908), for the specific performance of a section 148 sale agreement, extends the period for collection of the outstanding sales amount by the court within the prescribed time frame by the trial court against the judgment. The previous preliminary decree was approved. And in favor of the Registrars with this Declaration that the Declaratory Holders shall deposit the outstanding balance considering the sale within a period of forty days. Decree holders who fail to submit the deposit within a fixed period of forty days file an extension request for the deposit. Money and the trial court exercising its powers under section 148, CPC accepted that the application had extended the required period and allowed the submitter of the order to deposit the money which was fixed. Not long after the expiry, the trial court passed the final order and the decision was granted in favor of the holders of the specific pretrial injunction for the authorities to hand over the suit PR directed to the interest holders and balance within the prescribed period. In case of non-sale sale, it was said that the rulers banned the dismissal of claims. As a result of the dismissal of the case, the trial court was offset by the fact that the original order was without jurisdiction in the matter of extension of time to submit the dues. And was the result of an illegal operation. The court, the entire building raised on it will automatically slip to the ground and getting the final decree will lose its significance and take the decree.
