Article 4 Constitution of Pakistan (1973), the dismissal of the appellant who was dismissed from employment against the order imposing a minor penalty before the Article 1212 Service Tribunal, was reinstated by the minor. Subsequently, he was retired from employment after attaining the age of the appellant. During the process of collecting the pensionary benefits, the appellant found that he had been fined Rs. The appellant alleged that he had been fined without presenting a charge sheet, making inquiries or giving him a show cause notice. In view of the appellant's restoration order before the service tribunal under which the appellant was fined, it cannot be said that the minor penalty was the result of a separate charge for which a separate department inquiry was initiated. The service tribunal should have done all the investigations. Properly there are no illegal or irregularities in aspects of the case, in an unstated order and no intervention was required.
