DR. MARIAM JAMILA JATOI versus PROVINCE OF SINDH THROUGH SECRETARY, HEALTH SINDH
In response to an advertisement in the R4 (1) Constitution of Pakistan, Article 199 Appointed Authorized Authorities who claimed to be qualified doctors and were Fellows of the College of Physicians and Surgeons of Pakistan, Special Cadre Doctors BP Applied for the recruitment of S18 Petitioners. Submitted that under the signature of the Minister of Health, the petitioners were appointed by the Petitioners to implement their appointment order and publish orders. There was no record of the Public Service Commission's recommendation for his appointment. R (1) was the Chief Secretary of the Sindh Civil Servant (Appointment, Promotion and Exchange) Rules, 1974 for all the positions of the BPS 18 Authorized Authority and the Minister could not be part of any authorized authority ie not a competent authority. Could not have been aware of. Applicants were elected letter by the Minister, through an unauthorized person, have no rights or the results can flow from such document.
