JAN MUHAMMAD versus MUHAMMAD MUSHTAQ QURESHI

The Appellate Court dismissed the request for transfer of Section 24 case. No direct allegation was made by the applicant about the credibility of the Presiding Officer of the court from which the case was sought to be transferred, the transfer was sought only on the fear that the two cases had been before the court. The decision was made by the same court which was between the same party and the property was the same. That the presiding officer of this court had kept his mind against the applicant. If the applicant is feeling any danger, he may not be compelled to take action in this matter before the same court, while the other courts will not suffer the respondents. If the case is transferred from one court to another in the same court, then the financial loss will be transferred to the same court for the same decision. \ R \ n
