The dismissal of the petition filed under Section 249A, CCPC for the conduct of Section 249A and 561 accused applicants was alleged by the trial court in their plea on any of the 24 grounds it raised. Their request was rejected without considering a ground. The case was presented before the trial court in 2001 and since then the applicants have been appearing in court remotely, but no witnesses have been examined by the prosecutor. Was it that applicants would be satisfied if the trial court was directed to record the evidence of the prosecution witnesses within a short period or a trial on merit to decide the application under Section 249A, CRPC? The court was directed by the High Court to record and conclude the evidence of the prosecution within a period of six months. Receipt of the order; and if such evidence has not been reached within the stipulated time, then the applicants will have the freedom to repeat the application under Section 249A, CR PC, which is decided by the trial court law.
