Arts 25 and 199 Constitutional Applicants The educational applicant challenged the self-financing scheme for discrimination on the basis that dual citizenship students who have passed the Intermediate or equivalent examination from Pakistan, under the said scheme. Unable to enroll in MBB Section / BD Section Courses. Students with dual citizenship who also took the Intermediate or equivalent examination were eligible for admission under the BE / BSc Engineering Scheme and for the application form taken by the applicant it was also eligible. There was no discernible difference that would justify such discrimination. Two sets of students who had dual citizenship who had taken intermediate or equivalent examinations from Pakistan, had different issues to deal with, especially the Disqualification was included by inserting a special clause which violated Article 25 of the Constitution. The former was not able to justify such discrimination. The High Court allowed the constitutional application and directed the special clause to be a controversial constitution, stating that no student should be deprived of the benefits of a self-financing scheme on such grounds and the authorities have been advised that They should ensure such discrimination. High Court order promulgated to exclude any student from being considered for the benefit of the scheme.
