Directed to hold. Re-polling at disputed polling stations, on the basis that an extraordinary percentage of votes were cast in favor of the returning candidate. The petitioner had re-polled before the High Court but during the hearing before the High Court, the re-polling was done and the application was dismissed before the High Court to challenge the order of the Election Commission under Article 199 of the Constitution. The competent and sustained Election Commission order was rejected and was the result of a misrepresentation of the patent record and was not open to challenge to the Election Tribunal through its remedy. Election request under section 52 of the People's Representation, in the field referred to in section 68 of the Representation Act, 1976, in exercising its powers under Section 103 AA of the Representation, challenged the re-polling order approved by the Election Commission. The filing of an election petition is not supported. The Election Commission of Peoples Act, 1976, exercises jurisdiction in such arbitrary manner as the unauthorized, unjustified and unlawful, limited scope of all investigations under Section 103AA of the Representation of the Supreme Court Act 1976 Passed over. Decisions made by the High Court and the decisions passed by the Election Commission, as well as the entire outcome of the constituency and gambling as a retired candidate from that constituency.
