Section 497 Criminal Procedure (XLV of 1860), Section 302/392/404/411 murder conviction, robbery, receiving stolen property, FIR grants were filed the same night that the accused was arrested on the same day. The FIR was not named, but the same day the alleged kidnapper made a statement under Section 161, CCPC, that at the time of the incident, the accused committed robbery and shot the victim when he refused to hand over the money. The suspect allegedly took the kidnapper with him and left him on the street. The alleged kidnapper specifically mentioned the details of the suspects and two prosecution witnesses also commented. They saw the suspect in the light of a tractor on the road at which they had left the prosecution's witnesses and the alleged kidnapper identified the suspect during the identification with the parade accused, along with any of the suspected kidnappers, the complainant or the prosecutor's witnesses. Could not identify enmity. The prosecution and the prosecution of the accused are already underway, in which case, the accused's bail application is dismissed.
