MST. ZAHOOR ELLAHI versus ADDL: COMMISSIONER (R)

Sections 10 and 11 Section 3 of the Withdrawal of Property and Displaced Persons Act (XIV of 1975) Section 3 Constitution of Pakistan, Article 199 Constitution Petitioner Applicants suspended the orders of the Settlement Commissioner under which their privileges on the land were canceled. Went and the respondent was allotted. Applicants subject to its entitlement believed that they had occupied the land since 1972. They had the right to buy the land and this right was not taken into account by the authorities. After the settlement rules were terminated, if any claim was pending, the claim could no longer be settled as the applicants had 1972. Had occupied this land since. Land retention and settlement was directed to execute the rights of the applicants in accordance with Section 3 of the Evacuation Property and Displaced Persons Act (repealed) Act 1978, according to which a constitutional application was allowed.
