The MDM was restored by the High Court Playa, which was taken up by the accused persons who had compromised the legacy of the deceased's acquittal when it was proved that the accused had committed the crime. It was granted, in connection with the trial, that Talaq Mir may be sentenced to either death or life imprisonment; the provision of section 302 (b), PPC, requires that the sentence determine the facts and circumstances of the case. To be considered, is to compromise on one or more heirs. The victim will be involved in the facts and circumstances of the case which must be taken into account in determining the quantum of punishment, but this will not be a final factor in itself, as all facts and conditions of the case must be considered only. If the heir has compromised the offender, he will not automatically apply the sentence of life imprisonment.
