RAJA ZAHEER AHMED KHUHARO versus PROVINCE OF SINDH THROUGH SECRETARY HOME DEPARTMENT
Article 27 Constitution of Pakistan, Article 199 Constitutional plea of Police Constable against the Shaheed quota applicant in the position of constable at the place of his maternal uncle (constable) who was killed during his service while applying for the post of constable. The FIR filed in connection with the murder of the deceased constable has denied that he had the authority to request the appointment for the post, suggesting that he died during private affairs. The applicant's claim did not fall within the jurisdiction of martyrs and legal heirs as set forth in paragraphs 5 and 6 of Standing Order No. 25 of 2008. For the appointment of constable against such quota, thus, he was not a provocateur. The High Court dismissed the constitutional application in the circumstances.
