Section 497 Bail exclusion and non-bailable offense Section 497, CR PC divides non-bailable offenses into two types (i) capital punishment, life imprisonment or ten years imprisonment and (ii) less than fine. ? Non-bailable offenses falling into the second category are punishable by a sentence of less than ten years in prison, and denial of an exception will result in bail only in extraordinary and extraordinary cases, such as, i) where the accused is likely to be absconding.
