MUHAMMAD YASIN versus GENERAL MANAGER, PAKISTAN RAILWAYS HEADQUARTERS OFFICE, LAHORE
Section 13 Service Tribunal Act (LXX of 1973), Retirement from Section 4 Service Appellant, who served in the Authority for almost 18 years, was examined by the Medical Board of Pakistan Railway Seed Board which completed the Appellant and Permanently disqualified for further services, upon filing a petition by the appellant, the authority was directed by the High Court to have a board of doctors from the Joint Military Hospital (CMH) Syed Board after the appellant's inspection. Upon inspection, the appellant was declared medically appellant. He was represented for rehabilitation, but as Chief Medical Officer of Chief Justice Pakistan Railway failed to present his report in light of the results of the CMH Board of Physicians, the High Court filed the Divisional Medical Officer, Pakistan Railway. Was instructed to ensure the hearing. Instead of submitting a report from the Chief Medical Officer, in response to the directives of the High Court, the Director Health and Medical Services relied on the psychiatrist's report by the Director of Pakistan Railways who was not the Chief Medical Officer. Dismissed the applicant's request for reinstatement, did not give his independent opinion and did not consider the report of the Board of Directors. The CMH doctors who declared her to be appellant's medically fit did not apply her brain and did not inspect the appellant herself. There was no reason to dismiss the report submitted by the Board of Directors of Directors, which directed the High Court in the constitutional petition filed by the appellant, recently.
