Article 2 (c) and 3 of the Constitution of Pakistan (1973), Article 199 Applicants for public property encroachment affected the proceedings of the authorities in connection with the issuance of notices under the Sindh Public Property (Elimination of Expulsions) Act, 1975. After its execution, the Sindh Public Property (Elimination of Barriers) Act, 1975 was not applicable. Investigations into the question of encroachment on public property were conducted, under which the applicant barred public property. The alleged execution of the lease in favor of the applicant was unlawful and without any jurisdiction records show that the lease proceeding in connection with any area which does not fall within the jurisdiction of the Sindh Katchi Population Authority. Has no jurisdiction as the applicant has claimed. The petition cannot be entertained in this way; the applicant can find any way available, including the right to appeal provided under the Sindh Public Property Act, 1976. Done
