Section 12 and 14 (5) of the Constitution of Pakistan (1973), Article 63 (1) (a) Returning officer's nomination papers of the candidate disqualifying Parliament serving in Pakistan Telecommunication Limited were rejected on the basis that the Returning Officer Which was an employer corporation. The government had 26% of the shares accumulated by the candidate. It was that the government had no share in the corporation, therefore, it could not be disqualified. Article 63 (1) (a) of the two types of candidates ), I.e. a candidate who was in the service of any law firm or any body owned or controlled by the government. Or that had no controlling share or interest in the government, no control of the government and no interest in the shares or corporation, except the fact that it was a legal entity in which 26% of the government's shares could not be demanded for disqualification. The Returning Officer approved and on receipt of his nomination papers, he was remanded as per the appeal allowed.
