MUHAMMAD SHER versus PROVINCE OF THE PUNJAB THROUGH DISTRICT COLLECTOR, BHAKKAR
Sections 42 and 54 of the Civil Procedure Code (v. 1908), AXXVI, R9 and Section 115 suits notice to the plaintiff for exceeding the official land for the land and immunity for sale to the plaintiff under the Kachchi Settlement Scheme Such notice, to be challenged by the source notice, was reported by the Local Commission (an adjudicator appointed by the court) that there was no suit for the trial court's motion to dismiss, which was rejected by the appellate court, the appellate court. Did not say anything about such a report, but observed that a lawyer should not be appointed. Rather, a Revenue Officer or an officer of the department should have been appointed as a municipal commissioner to appoint an appellate court to meet with the local courts after they expressed dissatisfaction with the local commissioner's action. Naughty of Section 115, the CPC High Court has directed the app to be directed to the appellate court. The elite court will decide the appeal after appointing a Revenue Officer, preferably a local prosecutor, to proceed with the trial.
