The petitioner / assistant collector filed the petition filed by the petitioners only once before the facts were not valid. The earlier order passed in the appeal was challenged and the question was quashed. It was no longer challenged; the final position was obtained. The courts correctly denied interference in the circumstances. There was no case for interference with the constitutional jurisdiction. This is how the High Court was made
