MEHR RIAZ UL HAQ versus ELECTION TRIBUNAL FOR DISTRICT SAHIWAL/DISTRICT JUDGE, PAKPATTAN
The Constitution of Pakistan (1973), Article 199 Constitutional Applicants Applicants and ents Responding to Illegal Corrupt Practices, contested for the seats of the Moderator and Deputy Moderator, the applicants were declared retired candidates and they were informed. The respondents filed an election petition against retired candidates, in which their election was challenged on the charge that they had alleged corruption in the election. The Election Tribunal accepted the election petition filed by the defendants and declared the selection of the applicants illegal and void, and the Election Commission was directed to retain fresh election justification by presenting oral and documentary evidence, Applicants have given evidence of corruption in the elections. Documents were submitted by the applicant on record without any objection by the applicants and the applicants did not present any evidence to deny the overwhelming evidence presented by the respondents. After discussing oral and documentary evidence presented by the parties, the Tribunal correctly appreciated the evidence on record and said that on the basis of the evidence, the Election Tribunal correctly decided that the petitioners Has revealed that the High Court has committed illegal and corrupt practices.
