MISTRI MEHRAJ DIN versus SHEIKH MUHAMMAD AKBAR
Section 114 and AXLVII, R7 Review Grounds Law provides that after the discovery of a new and important case of evidence, the powers of review can be exercised which were not in the knowledge of the party or could not be presented at that time. The decree was approved or ordered that a review be made in the presence of the record or for any other reasonable reason, for any mistake or omission. No such compelling reason was made before the first appellate court but it was appealed by the applicants. The court had established a contrary view of the applicant and was wrong, so it is difficult to review such a point, so the applicants should have knocked on the door of a higher forum. The law had no scope for review. Reasons for approval of the review, in which case, the clearly missing petition was excluded.
