NOOR ELLAHI versus MESSRS TRADING CORPORATION OF PAKISTAN (PVT.) LTD.
A. XXI, Rr 77 and 92 High Court Ordinance Powers (XLII of 1980), Sections 3 and 7 Notice / Sale of Tender Authority of Court, in which competing bidders are given a chance to improve the auction price. Was acquired on this basis. In order to follow O XXI, Rr 77 & 92, the court ordered the sale of the price as indicated by the tender / sale notice, as the sale was never completed before the official / commissioner. Has the option to confirm because the court is only comfortable and the fact is that the purchase price was to be paid by the court within 15 days from the date of confirmation and not before the auction, after the completion of the bid. The balance was not paid or bid was made before the Government Assistant / Commissioner. The terms and conditions of the tender / sale notice were not being refused to participate in the sale of the notice, in the circumstances O XXI, R 77, has no resemblance to CPC so no one related to A-X's C-77, CPC principles. Cannot be quoted.
