ISHRAT JABEEN SAEED versus MULTAN DEVELOPMENT AUTHORITY THROUGH DIRECTOR GENERAL
Section 4 (g) Development Authorities (Regulation) Rules, 2002, R6 (c) Contract Act (IX of 1872), Section 2 of the Constitution of Pakistan (1973), Article 199 Constitutional Request Housing Scheme which was approved by the Development Authority. The applicants have requested the allotment of plots in favor of the applicants to the advertisement inviting applications for plot allotment through the Bell Scheme. Allotment by the Authority on the violation of such condition by the applicants, it has been declared by the applicants that the contract cannot be made thereafter for not mentioning in the advertisement as to their success. The deal was completed after a close draw. The condition is that if both husband and wife succeed in plot d, only one spouse will have the right to retain the custom plot. If submitting the form is considered an offer, then acceptance is subject to this condition. Under the circumstances no agreement was reached between the parties. By submitting an affidavit, the High Court dismissed the constitutional petition
