Sections 124 and 196 (2) of the Punjab Local Government (Property) Rules, 2003 Constitution of Pakistan (1973), Article 199 la Reforms Ordinance (XII of 1972), Section 3 intra-Court of Appeal Respondent filed a constitutional petition which was filed locally. The Council / Authority was challenged by the Appellant to auction the property lease agreement of the Local Government Order that the lease granted in its favor in the year 2000 was made pursuant to Section 196 (2) of the Local Government. Can be extended to As per the law of the Punjab Local Government Ordinance, 2001, any document or agreement shall not be affected unless it is inconsistent with any provision of the Ordinance and if there is no contradiction in it the provisions of the Punjab Local Government. Can prevail over Section 124. The ordinance, 2001, was read with the Punjab Local Government (Property) Rules 2003, under which it was constituted, under which the local council was obliged to lease the properties of the local people. The Government shall comply only with open auction and competitive bidding under sub-rule (2) of Rule 9 of the said Rules. Following the High Court, the High Court directed the Local Council to conduct a new auction according to the law.
