SHAHID ASLAM versus ELECTION TRIBUNAL WAZIRABAD TOWN AT HAFIZABAD/ADDITIONAL DISTRICT JUDGE
Section 152 (1) (e) of the Punjab Local Government Election Rules, 2005, Articles 65, 76 and 77 of the Constitution of Pakistan (1973), Article 199 Constitutional petition against the applicant for selection of the nominee and the educational qualification of the deputy nominee candidate. They have to confirm that their name is the same used when submitting the Matriculation Certificate and the papers, while the evidence on record shows that both names are the same, but their date of birth, school and roll number are different from each other. The Petitioner Failed Matriculation Examination Tufket and the defendants were announced as candidates. After recording the evidence of the parties, the Election Tribunal was in a position to pass an order which could not be exercised in the constitutional jurisdiction. The High Court refused to intervene in an unknown order and dismissed the constitutional petition.
