CHOUDHRY ARIF HUSSAIN versus STATE
The Special Judge had directed a section 27 petition against the order passed by the Anti-Terrorism Court, whereby the court imposed a fine of Rs. 50,000 on the applicant as he was found by him when he appeared regularly in court. Had violated the terms of the bond because the applicant was convicted. Applicant's request for exemption of time was allowed to pay a fine of Rs 1 lakh, but he subsequently failed to appear before the court and trial, 50 without bond. 000 was fined, after the proceedings against the applicant were terminated. The verdict was not pending and the petitioner stopped working after the date the bond was executed. Before being fined for breach of bond, the court first required a fine and then issued a notice to the person concerned to explain why the penalty should not be imposed, saying the proceedings were also not authorized. Because the bond was not seized before the applicant was fined, it was ordered to be illegal.
