LT. COL. (R.) ABDUL WAJID MALIK versus GOVERNMENT OF THE PUNJAB
Section 4 Constitution of Pakistan (1973), Article 212 (3) Service Benefits Officer for Special Duty (OSD) Government employee complained that while being posted to the OSD, he was charged with Deposit Allowance, POL. And additional benefits were not provided in the form of residential telephone. Convenience charges Appeal filed by state employees was dismissed by the correctness of the service tribunal, no deposition allowance, POL charges and residential telephone facility charges were specified for the OSD position. Was ignored for the fact that no official responsibility was imposed during his posting as OSD. It was assigned and in the absence where POL and residential telephone service charges could not be paid because such payment was not intended for public employees to fail to provide any reason why the state treasury was unable to pay. Such an additional burden can be justified, when no governmental responsibility was entrusted to it. The civil servant had no legal right to claim such benefits. Any violation question arises. Not a public servant in a position or grade can claim an approved salary for the position of OSD. Because the salary sanctioned for such a post cannot be claimed, nor any other benefits which were not approved for such post, the employee was referred to the decision by the illegal or irregular Service Tribunal.
