PREMIER INSURANCE COMPANY PAKISTAN LTD. THROUGH CHAIRMAN versus ANIS A. SHEIKH
A VII, R 11 (c) In the present case rejecting the plaintiff's condition of the plaintiff, the petition for dismissing the plaintiff was moved due to reduction of court fees and the response was filed and required at the hearing of the arguments. The court fee was paid and the plea bargain was dismissed, accusing the plaintiff of contradiction, and demanding the dismissal of the plaintiff and claiming that the case was pending against the plaintiff. When the fee was imposed, the defendant could not be supported by the court as the record showed that the court had imposed a fine on it under OVII, R 11 (c), CPC. The execution of the case did not bother, and under the decree the plaintiff was instructed to dismiss the plaintiff to pay court fees. Rule 11 (c), CPC, must meet two conditions; first, the court should have determined the amount of the compensation fee, positively and specifically, which the plaintiff was required to pay / affix to the plaintiff. Secondly, the plaintiff must be allowed reasonable time to meet the reduction of the court fee amount.
