SHEIKH ABDUL HALIM AND OTHERS versus GHULAM NABI THROUGH L.RS. AND OTHERS
Sections 24 and 27 of the Special Relief Act (of 1877), Section 12 of the West Pakistan Family Court Act (XXXV of 1964), Section 5 of the Guardians and Wards Act (VII of 1890), of the Constitution of Pakistan (1973), Section 185 of the Arts (3) and accumulation of property value in 187 pre-emption suit court, increase in real estate prices by 25 years delay in decision of suit and decrease in value of money during that period. The Supreme Court's decision to grant a successful premier 25 years ago allowed the appellant to consider the question, even if there was an extraordinary delay in the settlement of the cases, the Supreme Court and other courts announced by the Supreme Court. Laws may be followed in which a successful pre-emptor should be allowed to own the property. Specific performance, care of minors under the West Pakistan Family Courts Act 1964 and the Gardens and Wards Act 1860 may also raise questions and so will the Supreme Court consider the matter.
