DIRECTOR, EXCISE AND TAXATION versus MUHAMMAD AMIN WAQF
Section 16 (I) (2) and 21 Constitution of Pakistan (1973), Article 199 Constitution Petition against a petition filed by the landlord to prevent the tenant's defense for non-compliance with the rent order. Order to dismiss appeal, the landlord filed an appeal against a dismissal order, which was allowed through an unrelated order under which the tenant's defense was terminated. Under the section 16 (2) of the Sindh Rented Premises Ordinance 1979 by the tenant controller, the order to withhold defense was inherently an interim order. This matter cannot be presented under section 21 of the Sindh Rated Premises Ordinance, the 1979 landlord claimed that the order passed under section 16 of the Sindh Rented Premises Ordinance 1979 was not an interim order, but it was a final order, The order passed under Section 16 (2) of the Sindh Rated Premises Ordinance, 1979, was dismissed because of the vacancy of the constitutional petition.
