NISHAT MILLS LIMITED THROUGH PRINCIPAL OFFICER, KARACHI versus GOVERNMENT OF PAKISTAN
Article 32 Any Clause of the General Clause Act (X of 1997), Article 24A Constitution of Pakistan (1973), Article 199 Constitutional Petition for the purpose of banning the representation of the Central Board of Revenue by the President of Pakistan. Has been banned without partnership. Under the constitutional jurisdiction of the Constitution without any delay and without giving any reason, the High Court, rejecting the President's order, informed the petitioner and remanded the case to President Pakistan with the instruction that: (a) The notice will be issued to the opposing party informing that a representation has been received, accepting the recommendations from the Federal Tax Ombudsman. (B) that a copy of the representation shall be provided to the opposing party. (c) That the Opposition may be given a reasonable opportunity to present a personal hearing or reply / comment / written argument. (D) that if the Opposition is given an opportunity to put its point of view through written submissions / arguments, appropriate time will be allowed to submit written submissions in response. ()) All priorities raised in the representation and written response / submission shall be considered and disposed of by order of speaking as required under Section 24A of the General Clause Act 1897. (1) That the reason for representing a time restriction shall be recorded in writing for the reason for such representation and the delayed concession in which the law in favor of the delayed apology shall be shown, The order will be included in the final order. And (g) that a copy of the full text of the order accepting or rejecting representation be provided to both parties simultaneously
