SHAFIQUE AHMED versus STATE
Sections 497 of the Criminal Procedure Code (XLV of 1860), Sections 302, 324, 337H, 114, 148, 149 and 504 guarantees, the grants of the accused detained for the past seven years, were not presented to the court after approximately 34 hearings. The jail authorities examined the prosecution last witness after about seven to seven years and they too were not delayed by the accused in dealing with the matter at the behest of the High Court as there was no prosecution even after nearly seven years had passed. He was successful in examining his witnesses. If, at a later stage, it was found that the accused was not guilty, then who would account for such a lengthy imprisonment? He had to face trial and answer criminal charges against him. Not punishing him and the accused for a period of 7 years, and especially in the near future when there was no possibility of an end to the case, was a great injustice and hardship. For the accused, the accused was sentenced to life on bail
