LT. COL. (R.) ABDUL WAJID MALIK versus GOVERNMENT OF THE PUNJAB
The Complaint of the Constitution of Pakistan (1973), Article 212 (3) of the Service Benefits Officer for Special Duty (OSD) was that while being posted to the OSD, he was charged with deputation allowance, POL charges and residential telephone. Additional benefits were not offered in the event of facilitation. Appeals filed by public servants were excluded by the correctness of the service tribunal, no deduction allowance, POL charges and residential telephone facility charges were specified for the post of OSD. Was disqualified from the position that there was no official duty at the time of his posting to the OSD, and in the absence where POL and residential telephone facility payments could not be made. There was no purpose to pay the civil servant could justify such additional burden on the public exchequer. There's no reason fails to make the duty was assigned to the civil servant did not have any legal right to claim such benefits. The question of any VI violation did not arise from the fact that a public servant stationed in a position or grade would be entitled to an approved payment for this post because OSD cannot claim only the approved salary for the post. Other benefits that were not approved for such a post were referred to a civil servant in a decision passed by the illegal or irregular Service Tribunal: no question of public importance law was involved in the matter. And traveled straight into the realm of objective thinking and because of personal prejudice there was a problem in it
