TEHSIL MUNICIPAL ADMINISTRATION, HAFIZABAD versus GOVERNMENT OF PUNJAB THROUGH SECRETARY, LOCAL GOVERNMENT AND RURAL DEPARTMENT, LAHORE
Section 127 (3) of the Constitution of Pakistan (1973), Article 185 (3) was held by the Secretary Local Government in connection with the holding of cattle market. The applicant believed that the Tehsil Municipal Administration was an independent authority, therefore, the Secretary, Local Government had no jurisdiction to grant that he would not hold cattle market on Wednesday. The accuracy secretary, the local government, was required to oversee the duties of the local councils, therefore, the directives issued by the provincial government for the holding of livestock. After the strict order issued by the secretary, the local government, the markets were affected, the High Court did not properly interfere with its order, the appeal was denied, the petitioner rejected the Supreme Court.
