The suit was decided to recover money with interest on the basis of section 34 of the Special Relief Act (of 1877), the question of whether the trial was permissible to interest the defendants Alihan conceded that the money was not paid to the plaintiffs due to non-availability of funds, but the plaintiffs paid with funds only, which showed that the payment was made after receipt of the funds according to the terms of the agreement. Should be, therefore, the trial court was not justified in paying interest to the plaintiffs because since the plaintiff was paid the actual amount, the appeal to that extent was invalid. It was of interest to the extent to the High Court had separated.
