HAJI GUL MUHAMMAD versus STATE
Before issuing arrest warrants of section 265, the trial court acquitted on the request of an accused filed under section 265, CCPC, but having passed an improper order, issued a non-bailable warrant against the accused persons. Despite leaving, the trial court did not bother to issue. In the first instance heard in the case, the accused was also referred to a notice, a copy of the challan, before the accused was involved in the crime to prove that some other person had been absconding. I was shown while the other accused was not involved. In any way affiliated with the crime, but as a co-accused in the case, he was also shared without any notice or given the opportunity to be heard before such order was approved.
