SH. JAMIL AHMED THROUGH LEGAL HEIRS versus ADMINISTRATOR MUNICIPAL COMMITTEE, ABBOTTABAD
Sections 61 & North 64 of the Northwest Frontier Province Public Property (Termination of Barriers) Act (v. 1977), Article 3 of the Constitution of Pakistan (1973), Article 185 (3) licensing property belonging to the licensors and relatives of the licensed property property. The construction of the property was owned by the municipal committee and the licensors extended the construction on which the municipal committee issued a notice under section 3 of the Northwest Border Public Property Act, 1977, under constitutional jurisdiction. The court directed the committee to pay the respondents. The municipal committee claimed that the defendant was not entitled to compensation for the construction because it was receiving regular house rent even after the original lease expired, so compensation was paid appropriately. Re-reconstruction by Vendors Even after the original lease expires, the Committee considers the defendants unauthorized occupants, calling it the Northwestern Frontier Province Public Property (Termination Explosion) Act, 1977. Section 3 permits him to own the premises until the notice is issued. In any case, the respondents' status was recognized as licensed in the law and it had a valid claim for construction compensation taken by the municipal committee's permission.
