SYED SABIR HUSSAIN versus HOUSE BUILDING FINANCE CORPORAITON, BAHAWALPUR THROUGH DISTRICT MANAGER
The plaintiff for the Section 9 and 16 debt collection had raised the fact that the house was destroyed by a severe flood in the dispute and the loss was due to the residence, the banking court said. Material fact did not create any problem and decided. Without explaining this important issue, such a realistic dispute should be framed as a problem because it was to materially affect the fate and decision of the matter and provide the parties with an opportunity to present their evidence. That was not the case, the banking court had. According to the law, the decision was not approved and the decision was rejected and the matter was returned to the Banking Court for further proceedings after presenting the matter to the parties, fresh for the parties to bring their evidence. Opportunity will be provided and after this matter a decision will be made on merit
