O XXIII, R 3 Arbitration Act (X of 1940), the agreement to predict a suit for a similar decision between the parties on a third person statement did not fall under the scope of O XXIII, R 3, CPC. Nor were the provisions of the Arbitration Act, 1940 applicable, that such statement between the parties could be withdrawn simply because of a contract, due to lack of trust by either party when the referee court recorded the referee's statement.
