MUHAMMAD ASIF MALIK versus IMRAN SAMI
A. XXXVII, RR 2 and 3 and Section 96 Limitation Act (IX of 1908), sec 5 suit, delaying the application of the restriction with the defendant's request for recovery of the money. Applied under Section 5 of the Limitation Act, 1908 Objecting to allow delayed petition, he said that the request was allowed and the petition was allowed to protect the amount of the dispute and the matter was postponed for filing a written statement. The defendant failed to provide security despite the opportunity provided to him. Many times, the trial court granted leave to defend the case, delaying the filing of the petition in the trial, the defendant was working on an ambiguous basis for the extension of time. He was generous and showed great flexibility over time. The matter should be decided on merit, but despite the opportunities provided to the defendants, he failed to take advantage of the case. The court was obliged to refuse the plaintiff's request as to the plaintiff, whose order for leave to defend was approved, which strongly opposed the request for an extension of time for the supply of protective equipment and the trial. The court had no option but to deny the plea arguing that the trial court's order was rigorous and that the issue of this case should have been decided on the merits of the case, in the case of trial. The trial court exercised integrity in keeping with the principles of the use of force
