In the initial FIR, the complainant on the accuracy of the High Court appeared in the court and recorded the statement that she was the accused's legitimate married wife and that the FIR was invalid and under this section 161 The statement was also filed under CRPC, on which the FIR was canceled. Disputes arose between the complainant and the accused, after which the complainant filed a false and unrelated FIR on the same incident, same story and same accused and could not be listed. In such circumstances, allowing the nominated FIR to remain in the field would be an act of misconduct. The process of law was passed by the High Court.
