SHAHID RASHID versus STATION HOUSE OFFICER
Section 7 337 H (II), 452, 506, 148 and 149 Constitution of Pakistan (1973), Article 199 Constitutional petition was filed against the applicant on the cancellation of the FIR respondent, but during interrogation The case was found to be false and accordingly there was a discharge report. The prepared magistrate, however, disagreed with the report and directed the police to furnish the challan. The petitioners had prayed for the dismissal of the FIR police officer present in the court which stated that the investigating officer had found the applicants innocent. Subsequently, the Investigation Investigation confirmed the investigation and the complainant did not appear before D-section P (Investigation), though instructions were issued in this regard, according to a report prepared by the section HO police station. It was found that no vacancy was recovered during the investigation nor was the complainant presented to the investigating officer. Residents of the area and locality said that no such incident had occurred and the complainant has filed a false case against the applicant in which the accused / applicant has been found innocent, the FIR against them has been terminated.
