The post was promoted. The court directed the department to consider the fitness of the deceased employee and another employee. After the employee's death, his legal heirs were not included as a party; in the absence of the deceased employee's legal heirs, an inquiry into his merits would not be appropriate. The case letter grant order was acquitted and the appellate authority was instructed to reconsider the case of both employees as per the High Court's directive if the late employee was found to be entitled to promotion to the post of Director General in accordance with the law.
