Section 12 (2) Constitution of Pakistan (1973), Article 199 Constitutional application for exclusion of ex parte decree based on fraud, was dismissed after recording the trial court evidence, but the amendment court engaged by the applicants. Approval was filed by the applicant and his lawyer due to non-submission, after learning about the former party directory at the trial, the applicant had to submit the application before the gift. There was no other alternative but to file an application earlier. His son was granted an impeachment order after reviewing the trial court's arguments on the land issue and re-examining the evidence on record. The High Court refused to act arbitrarily in favor of the petitioner. And dismissed the constitutional application
