Sections 3 and 10 of the Northwest Frontier Province Civil Servants Act (XVIII of 1973), Section 2 (b) Constitution of Pakistan (1973), Article 1212 (3) mandatory retirement of an employee of such legislation were excluded by the service tribunal. On the basis that he was not a civil servant, although employed by the Secondary Education Board under Section 2 (b) of the Province Border, Civil Servants Act, 1973, illegally removed his retirement from service in Section 3, the Border ( Special options) were ordered. The Ordinance, 2000, and section 10, in which to deal with the appeals, were expressly stated that, irrespective of anything contained in any other law up to that time, any person enjoined by any final order was bound by the State Border Service. The Service established under the Tribunals shall prefer the appeal to the Tribunal. The Service (Special Powers) Ordinance, 2000 from the Frontier Province Act, 2000 being the final special law, a forum of appeal was provided to each person acting under this order. Therefore, the Hon'ble Appeal Service was authorized before the Tribunal, which the Tribunal had erroneously dismissed for leave of appeal, after the change of appeal of its Supreme Court was accepted and the case was adjudicated for good.
