MESSRS G.A. STEEL RE-ROLLING MILLS THROUGH MANAGING PARTNER versus MUSLIM COMMERCIAL BANK LIMITED, THROUGH REGISTERED OFFICE
Section 9 General Clause Act (X of 1897), Section 24 Application for leave of suit for recovery of debt amount The plaintiff's request was that the documents filed with the plaintiff, including the financial transaction agreement, were fake and false, The THC Banking Court dismissed the leave petition and ruled that the legal matter without dealing with the defendants' requests was bound by the Banking Court to deal with such requests through a legally reasonable decision. As per the directions of the High Court, the bank kept record of additional documents including the approval of the finance, approval and complete statement of the accounts. The banking court had deprived the inspection of such documents during the decision of leave application if such documents. Had the first been on record, the fate of the leave application and the case might have been different. The Banking Court is then directed to decide the case in accordance with the law, and to consider such additional documents, if filed by the respondent.
