MUHAMMAD BOOTA versus ELECTION TRIBUNAL
RR (80 (c), & 82 & (83 (a) Punjab Local Government Election Ordinance (V of 2000), Section 2 (10) Constitution of Pakistan (1973), Art: 185 (3) Election for Farmer / Seat) In the constitutional petition, the High Court reversed the tribunal's order as the election tribunal rejected the selection of the respondent as the lack of eligibility for the election. There was nothing available to indicate that a fresh election was held to be a candidate. The lack of respondents' ability was notorious in nature and voters were conscious. Whether or not he was aware, at the time of scrutiny of the nomination papers, no objection was taken to the Returning Officer that the respondent was not part of Punjab as defined in section 2 (10) of the Punjab Local Government Election. Regarding voters in favor of the Ordinance, 2000, it cannot be said that in the presence of more than two competing candidates, voting was done in favor of the applicant. Can't be thrown out for disqualification from voters. r \ n
