Appeals of the accused under Section 409/379/411/109 Forest Act (XVI of 1927), Section 58 Criminal Procedure Code (V9 1898), Section 439 Revision Request Section 249A, CR Pcd. Joey's confession was not a public servant, nor was he in any way entrusted with the suspect's property or dominated by the provisions of Article 409, PPC, therefore, the Forest Department's compensation / damages against the accused was not attracted. It was estimated that Rs 47,500 was paid by the accused forester and under the law, the block officer was capable of committing forest crimes in his jurisdiction. The defendants should not be prosecuted after they were paid the value of the stolen property and were to be relinquished, as provided under section 6868 of the Forest Act. Thus, 1927, no action was taken against the accused for theft of forest wood, as it was merely an act of contempt of court. As a result, the rudder was set aside and the accused was acquitted of the charge.
